Please read these terms carefully before using Fontiex. By creating a FIN account or using any platform services, you agree to be bound by these terms.
1. Definitions
"Fontiex" refers to the membership platform and service operated by Dutch Bangal, registered in the Netherlands with KVK number 89312678, with its principal place of business at 8911 KM Leeuwarden, The Netherlands. "FNX" means Fontiex service credits — a prepaid platform credit unit priced 1:1 with EUR, used to access services on the Platform. "FIN" means Fontiex Identification Number, your unique Fontiex membership identifier. "R" means Reciprocity credits, community participation credits earned through platform activity. "Member" means any registered user holding a valid FIN. "Platform" means the Fontiex web application available at fontiex.com, its mobile interfaces, and associated APIs. "Dutch Bangal" refers to the operating entity behind Fontiex (KVK 89312678).
2. Acceptance of Terms
By registering for a FIN or using the Platform in any capacity, you agree to be bound by these Terms & Conditions in full. If you do not agree, you must not use the Platform. These terms apply to all membership tiers: Free, Starter, Pro, and Enterprise. Fontiex is currently in public beta. Features may change, and some aspects of the service are still being developed. We will notify you of material changes at least 14 days in advance. Continued use of the Platform after the effective date of a change constitutes acceptance.
3. Nature of FNX Credits
FNX credits are prepaid platform service credits denominated in EUR on a 1:1 basis. They are not a currency, cryptocurrency, e-money, investment, security, or financial instrument of any kind under Dutch or EU law. FNX credits have no speculative or investment value. They are not redeemable for cash on demand except upon account closure as described in our Refund Policy. No financial return, profit share, dividend, or capital appreciation is implied or promised. The administrative reference rate for FNX may be adjusted by Fontiex at its discretion, with 14 days' notice to affected members.
4. Membership & Subscription
Fontiex membership is available in four tiers: Free, Starter, Pro, and Enterprise. Each tier grants access to platform features as described on the pricing page at fontiex.com. Monthly platform fees applicable to your tier are deducted from your R balance or charged separately. Membership is personal and non-transferable. You may not share, sublicense, sub-let, or transfer your FIN to any third party. Fontiex reserves the right to suspend or terminate membership for violation of these terms. Fontiex is a product of Dutch Bangal and is distinct from Dutch Bangal's other services and products.
5. Acceptable Use
You agree to use the Platform only for lawful purposes and in accordance with these terms. You must not: (a) engage in or facilitate fraudulent, deceptive, or misleading activities; (b) impersonate any person or entity; (c) circumvent or attempt to circumvent any access controls, security measures, or technical restrictions; (d) upload, transmit, or distribute malware, viruses, or any harmful code; (e) violate any applicable local, national, or international law or regulation; (f) engage in money laundering, terrorist financing, sanctions evasion, or any other financial crime; (g) use the Platform to harm, harass, or discriminate against other members. We cooperate fully with Dutch and EU law enforcement authorities and regulatory bodies.
6. Bookings & Partner Services
Services available on the Platform may be provided by third-party partners. Fontiex acts as a facilitator between members and service partners and is not a party to the service contract between you and the partner. Fontiex is not liable for the quality, availability, accuracy, or suitability of partner services. Bookings made using FNX credits are subject to individual partner terms and cancellation policies. Where a booking is cancelled by a partner, FNX credits will be returned to your wallet within 7 business days. Where you cancel a booking, credits are returned subject to the partner's cancellation policy. Fontiex does not guarantee the continued availability of any listed service.
7. Payments & Processing Fees
FNX credit top-ups are processed via Stripe. Payments are denominated in EUR. A processing fee (currently 3.5% + €2.00) is charged to cover card and payment network costs; this fee is non-refundable. Fontiex does not store card details. All payment processing is handled by Stripe in accordance with Stripe's own terms and privacy policy. In the event of a failed payment, your FNX balance will not be credited until the payment is confirmed. Disputed or fraudulent chargebacks may result in account suspension.
8. KYC & Identity Verification
Fontiex operates a self-declaration KYC process. Upon registration or when adding a bank account, members are required to submit identity and bank account information, including name, date of birth, nationality, country of residence, and relevant bank details. A Fontiex Account Identifier (FAI) number is generated upon successful submission. Fontiex reserves the right to request additional documentation at any time. Providing false or misleading KYC information is a material breach of these terms and may result in immediate account termination and referral to relevant authorities.
9. Intellectual Property
All content on the Platform — including the Fontiex name, logo, designs, interface elements, text, code, and service descriptions — is the property of Dutch Bangal or its licensors and is protected under Dutch and international intellectual property law. You may not copy, reproduce, modify, distribute, reverse-engineer, or create derivative works from any Platform content without our prior written consent. Your personal data and FIN account data remain yours, governed by our Privacy Policy. User-submitted content (if any) remains your property; you grant Fontiex a limited licence to display it within the Platform.
10. Limitation of Liability
To the maximum extent permitted by applicable Dutch and EU law, Fontiex and Dutch Bangal (KVK 89312678) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including loss of FNX credits due to account suspension for terms violations, service unavailability due to technical failures, or actions of third-party service partners. Our total aggregate liability for any claim shall not exceed the total value of FNX credits held in your account at the time of the claim. Nothing in these terms excludes liability for fraud, gross negligence, or any liability that cannot be excluded under Dutch consumer law (Burgerlijk Wetboek).
11. Governing Law & Disputes
These terms are governed by and construed in accordance with the laws of the Netherlands. The courts of Leeuwarden (Rechtbank Noord-Nederland) have exclusive jurisdiction over any dispute arising from these terms or your use of the Platform, unless mandatory consumer law provisions in your country of residence require otherwise. Before initiating formal proceedings, we ask that you first contact us at legal@fontiex.com to attempt good-faith resolution. EU members also have access to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
12. Termination
You may close your Fontiex account at any time from your account settings or by contacting support@fontiex.com. Upon termination, your FIN will be deactivated and unused FNX credits will be refunded subject to the Refund Policy for your tier. Fontiex may suspend or terminate accounts immediately — without prior notice — where it reasonably suspects fraud, misuse, terms violation, or conduct that poses a risk to other members or the Platform. In such cases, we will notify you as soon as reasonably practicable and you may appeal by contacting legal@fontiex.com.
13. Amendments
We may amend these Terms & Conditions at any time. We will notify you by email to your registered address and by a notice on the Platform at least 14 days before material changes take effect. If you disagree with any amended terms, you may close your account and request applicable refunds before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised terms.
